HOLIDAY HOME REGULATIONS


1. General provisions

· The regulations define the rules for booking, payment, cancellation and stay at the Under The Spanish Sun holiday home.

· Making a reservation means acceptance of these regulations by the person making the reservation and all participants of the stay.

· These terms and conditions apply to direct bookings. For bookings made through external portals, additional terms and conditions may apply.


2. Check-in and check-out

· Check-in: from 16:00 to 22:00.

· Check-out: from 08:00 to 11:00.

· The guest should inform the property in advance of their expected arrival time.

· Early check-in or late check-out requires prior arrangement and confirmation by the property.


3. Reservation and payment

· The reservation is confirmed after the property confirms the availability of the date and after the prepayment is made.

· The prepayment is 50% of the booking value and must be paid within 3 days of making the booking.

· A final cleaning fee of EUR 150 is added to each booking.

· The cleaning fee is included in the price calculation at the booking stage and is part of the total amount to be paid.

· The full amount of the reservation (including the remaining 50% and the cleaning fee) must be paid at least 14, 30 or 60 days before the check-in date, depending on the season.

· The date of payment is deemed to be the date on which the funds are credited to the facility's account or the effective receipt of payment by another agreed method.

If full payment is not received at least 10, 20, or 30 days prior to check-in, depending on the season, the property reserves the right to cancel the reservation. In this case, the prepayment (50% of the booking value) is non-refundable.


4. Number of guests and children

· Only persons registered during the booking may stay in the facility.

· When booking, please provide the exact number of guests, including children.

· The property provides an additional baby cot upon request.

· Exceeding the declared number of people without the facility's consent may result in refusal of accommodation or additional fees.


5. Rules of stay

· Guests are obliged to use the facility in accordance with its intended purpose and with respect for neighbors.

· It is prohibited to organize parties, receptions, hen and stag parties or other events that may disturb the peace in the facility.

· Night silence applies from 11:00 p.m. to 7:00 a.m.

· Smoking is prohibited in the facility.

· Pets are not allowed unless the property has given prior written consent.


6. Liability for damages

· The guest is financially liable for any damage caused by him or her or any persons staying with him or her in the facility for which he or she is responsible.

· If damage is discovered after the stay, the property has the right to charge the Guest for the costs of repairing or restoring the damaged property in accordance with the actual cost and documentation of the damage.

Guests are required to secure the awning on the terrace in accordance with the regulations, i.e., it must be secured with two chains attached to the awning and must be retracted when not at home. Damage to the awning may occur, for example, due to wind or precipitation. The guest is responsible for the repair costs. In a worst-case scenario, the repair costs can be up to €1,200.


7. Refusal to provide service / shortening of stay

· The facility reserves the right to refuse check-in or shorten the stay without refund in the event of a gross violation of the regulations, in particular the organization of events, disturbing the night time silence, smoking in the facility, exceeding the number of guests or aggressive behavior.


8. Final provisions

· In matters not regulated by the regulations, the provisions of the law applicable to the location of the facility shall apply.

· The Regulations constitute an integral part of the booking conditions and are made available to the Guest before making payment.


PAYMENT AND CANCELLATION POLICY


1. Payment Policy

· Reservation requires a prepayment of 50% of the reservation value within 3 days of confirmation of the reservation.

· The full amount of the reservation, including the cleaning fee added to the reservation, must be paid at least 10, 20 or 30 days before check-in, depending on the season.

· Failure to pay in full by the due date constitutes a breach of the booking terms and conditions and may result in the property cancelling the booking.


1.1. Last minute bookings (within the free cancellation period)

· If the reservation is made earlier than the free cancellation period applicable for the given season, the reservation is non-refundable and requires payment of 100% of the total reservation amount at the time of confirmation.

This applies to the following terms:

· - Low season: reservation made 14 days or less before check-in date.

· - Mid-season: reservation made 30 days or less before check-in date.

· - High season: reservation made 60 days or less before check-in date.

· In the case of such reservations, cancellation by the Guest will result in no refund of the funds paid (non-refundable reservation).

· The above provisions apply subject to mandatory provisions of law.


2. Free cancellation (depending on the season)

Low Season (November 1st - April 30th): Free cancellation up to 14 days before check-in date.

Mid-season (May-June and September-October): Free cancellation up to 30 days before check-in date.

High season (July-August): Free cancellation up to 60 days before check-in date.


3. Cancellation after the free cancellation period

· In case of cancellation after the free cancellation period, the prepayment (50% of the booking value) is non-refundable.

· This also applies if the reservation is canceled by the property due to non-payment in full, depending on the season, at least 10, 20 or 30 days before arrival.


4. Failure to pay in full, depending on the season, no later than 10, 20 or 30 days before arrival

· If the Guest does not pay 100% of the reservation amount, depending on the season, at least 10, 20 or 30 days before the check-in date, the property has the right to cancel the reservation.

· In such a case, the reservation is considered to be canceled due to the Guest's fault and the prepayment (50% of the reservation value) is non-refundable.


5. Cancellation, depending on the season, less than 10, 20 or 30 days before arrival

· In case of cancellation less than 10, 20 or 30 days before check-in (e.g. 6 or 5 days before arrival), depending on the season, the deposit will not be refunded.

· If the Guest has already paid for the entire reservation, the entire amount paid is forfeited and non-refundable.

· This rule results from the limited possibility of re-renting the facility in such a short period of time.


6. Guest no-show

· In the event of a no-show on the day of arrival without prior effective cancellation in accordance with the terms and conditions, the deposited funds are non-refundable.


7. Shortening your stay

· In the event of early departure after the start of your stay, the fee for unused nights is non-refundable.


8. Cancellation form

· Cancellation of a reservation must be made in writing (e.g. e-mail or message via the reservation system).

· The date of cancellation is the date the property receives the message.


9. Legal disclaimer

· The above conditions apply to the extent permitted by applicable law.

· This policy does not exclude consumer rights arising from mandatory provisions of law.


10. Additional provisions for compliance with consumer law (Spain / EU)

· Reserving accommodation for a specific date or period of stay is not covered by the standard 14-day right of withdrawal from a distance contract, except for cases provided for by mandatory provisions of law.

· If the property cancels the reservation for reasons attributable to the property (and this is not due to a breach of the regulations by the Guest or force majeure), the Guest is entitled to a refund of all payments received for the service not provided, including fees charged at the time of booking.

· The provisions regarding the loss of prepayment or non-refund are of a compensatory nature and are applied within the limits of the actual damage suffered and the lost opportunity to re-rent the date, taking into account the mandatory provisions of law.

· Guests may submit complaints or grievances in writing to the property's contact address. The property will respond without undue delay and no later than the deadline required by applicable regulations. Information on the complaints procedure and available alternative dispute resolution options is available upon request.

These terms and conditions and policies do not limit consumer rights under mandatory law. In the event of conflict, Spanish law and EU law applicable to accommodation services shall prevail.
